D.A.: Bills' Lynch in vehicle at time of accident - Yahoo! Sports

Erie County D.A. Frank Clark has named Marshawn Lynch as the "principal suspect" in his ongoing investigation of last week's hit-and-run incident. Lynch was in the vehicle at the time of the accident, but police nor Clark are sure if he was the driver. Either way, things are looking worse for Buffalo's best player. Please discuss here.

Now that what we dreaded all along has apparently been confirmed I don’t see any way Lynch avoids a lengthy suspension. He might be able to arrange a plea deal with the prosecutor where he does very little jail time and a ton of community service. He won’t get any such deal from Goodell.

Lengthy

I can easily see a season long suspension. I could even see Goodell even doing an indefinite suspension, though that seems far less likely. While Jerry Jones might be able to wrangle limited punishment for players, Ralph Wilson doesn’t have that kind of juice.

Lynch hit a woman and drove home without stopping to render aid. Never mind that he was probably too drunk to drive or that he was amazingly self centered. He left a woman in the road and drove away. While she wasn’t-thankfully-seriously injured, for all Lynch knew she could have been dying. His behavior, assuming what we have learned about the hit and run is accurate, was loathesome and reflects poorly on the league. We can only hope that his behavior was due to booze and not a true indicator of Lynch’s overall character.

I’m not making the claim that Lynch isn’t in the wrong here – clearly, his behavior left a LOT to be desired. But I’ll reiterate: this is a misdemeanor. I wouldn’t be shocked to see a suspension the length of what you’ve been mentioning, but Goodell would be in the wrong there. I’ll stick by my 4-game max “prediction”.

Dumb Luck

That’s really what the difference between a misdemeanor and felony comes down to in this situation. Fortunately for everyone concerned (the lady, Lynch, the Bills, the NFL, us), the woman wasn’t seriously injured. She just as easily could have bounced her noggin off the pavement and sustained a traumatic brain injury. Lynch (and everyone concerned) caught a lucky break. I don’t think we can count on Goodell cutting Lynch another.

With that said, I’m hoping Lynch’s luck holds and that he draws mainly community service from the state and a brief suspension from the NFL. Hopefully he learns from this. I’m not talking so much about learning not to drink and drive. I’m hoping that he takes a hard look at himself and becomes a better person.

Attitude

Since this is Lynch’s first problem, he may get the benefit of the doubt from Goodell. Many facts still need to come out, but it may very well depend on his attitude when he has his “talk” with Goodell. My best case guess is 2-4 games, which will probably be just enough to keep the Bills out of the playoffs.

I think it'll be longer...

if he was behind the wheel. Hit and run is very serious. To leave someone in the street goes beyond the term “mistake;” its criminal.

I have no idea what Goodell will do, but if Marshawn was behind that wheel, he is in loads of trouble. Half the season minimum. We need to look at the high-profile Goodell suspensions to see what Marshawn would be looking at. Goodell clearly looks into two factors: 1) number of run-ins and 2) severity of damage to the public. Pacman had multiple arrests and allegedly called for the shooting that took place in Vegas. Chris Henry has had multiple arrests and assaults, but none of them as serious as Mr. Jones’ where someone can’t walk again because Pacman needed justice for being insulted. Tank had multiple arrests for gun possession (aggravated assault and resisting arrest when he threatened a police officer as well). No one hurt, though much more potential for serious public injury than the Chris Henry ridiculousness.

Marshawn has never been arrested, so this is a unique situation for Goodell. There really is not a good precedent. That said given the severity of the crime if committed, I think the Tank “Send Lawyers, Guns and Money” Johnson suspension seems like a good basis for looking for a suspension time-frame. Though Tank never shot anyone, he kept loaded guns around his kids and in his vehicles. And although no one was directly harmed by this, he had the potential to do real physical damage. Marshawn, on the other hand, potentially blasted a ped and kept going. She could have been dead for all he knew and he kept rolling. Though he’s committed only one crime, he harmed a member of the public; and its a blessing, for that matter, that she wasn’t more seriously injured. So, my feeling, not so much based on anything concrete mind you, is: though only one time, three times the crime. Tank was suspended for 10 games (6 served?). I think that’s what Marshawn is looking at. Too severe? Look at it another way: if she had been killed, we wouldn’t be discussing the length of suspension, but the length of jail time.

That said, we have three other backs currently on the roster. If there is one position in the NFL that is the easiest to fill, its RB. So, perhaps someone can step up during that time. I still have hope, I hope.

That may be extreme, DCRumbler, because in the case of everyone you mentioned above save Lynch, those were felony charges. Lynch would be facing a misdemeanor – so if he’s suspended, I doubt it would approach what Johnson and Henry got (8 games). 4 would be the maximum in my mind.

Lynch wouldn’t be facing just one charge, either – if he continues to avoid police, he could be staring obstruction of justice charges in the face, too.

No Obstruction of Justice

If Lynch is the driver he cannot have an obstruction of justice charge due to the 5th Amendment. Lynch has every right not to implicate himself. Therefore he does not have to talk with police, especially since he has yet to be charged, arrested and is not under subpoena If he is not the driver, then there is no obstruction of justice until there is a subpoena requesting lynch to speak.

Multiple infractions

Those guys also had multiple run-ins with the law. This is Lynch’s first such problem (not counting that fishy battery charge or whatever it was that was dropped).

I’m guessing 2-4 games tops, and that might not even be this season depending on when the dust settles.

Remember Anthony Hargrove punched a cop and didn’t get suspended for it. He got nailed for the illegal substances he so thoroughly enjoyed.

I really think many of you are getting a little more upset than you should. If Lynch is guilty of hitting the woman and driving away, then he should get a short suspension and a fine on top of the fine/community service/settlement he’ll be facing from the court system. I really don’t see how this would warrant such a long suspension, if at all. Maybe I’m in the minority here, but I heartily disagree with many of the opinions on this topic.

NY Law vs. NFL Law

OK, I might agree. But I’m not sure that whether the legal classification matters to Goodell or not. This is a case where a women got mowed down and was, quite frankly, left for dead. Yeah, I know, she only had some bruises and a few stitches, but that is amazing considering the impact was such that a piece of the Porsche was left at the scene.

Yes, its only a misdemeanor; property and persons are treated equally in the State of New York in terms of hit and run incidents depending upon severity of injury. However, I wonder if Goodell would make that same distinction. Does public outrage play a role in his decisions? I really don’t know and I would have a hard time believing it did. But I would also argue that he has never had another player guilty of such a “severe” misdemeanor (hypothetically, for this post, Marshawn is guilty). Although we would need to see the bylaws and NFL-NFLPA agreements to really know for sure, I don’t think Goodell is not bound by State Law in NFL matters and is free to determine suspension length as he sees fit. If he is outraged as some in the public, as Kurupt has pointed out, than I think Marshawn could be lost for half a season.

And, if I may Kurupt, I think there are a couple factors as to why people are as upset as they are: 1) As I asserted above, he hit someone and left them for dead (again, allegedly), 2) misdemeanor or not, that action is viewed by many to show not only a complete lack of character and judgment, but a malignant constitution as well; and 3) he has said nothing, and if he did it, he should be begging everyone for forgiveness.

Mind you, I don’t really ascribe to the above attitude as I stated it, and I certainly think that everyone should have a fair shake and due process. But, for me, the 500lb gorilla in the room is that he was probably drunk (if he did it). No matter how impaired your judgment is, getting behind the wheel after one too many is extremely serious no matter the outcome. That is what upsets me on a personal level (as well has him hitting that poor woman, of course). Ultimately, I don’t know what his final suspension numbers are going to be, but he will have to work hard to get back in the good graces of some.

Marshawn doesn't have a clean history

Unfortunately, Marshawn’s “record” is not that clean as you indicate. He was never convicted, but he was charged with assault on his girlfriend (I think she decided not to press charges), and there was a shooting incident where he was supposedly an innocent victim. Prior to the draft, his troubled past was debated—frankly, just like Hardy’s. Goodell may not penalize him for his past, but it wasn’t exactly “clean.”

Incidents

The assault charge ended up being bogus. And Lynch was in the area of the shooting while attending his sister’s graduation. In fact, the shooter’s “representative” went to Lynch’s mom’s house to apologize and explain that Lynch was in no way the target.

I’m sorry, but if the commish is holding those things against him, then we have a guy with too much power making decisions involving suspensions and whatnot.

Suspension and Other Bills

This has the potential to be very bad, especially if the other people in the car were also Bills players. Some of the witnesses have said that Lynch was out with other Bills players that night so its entirely possible that they were in the car with him. This could very well be the reason that Lynch is keeping his mouth shut because he knows they are going to ask him who was in the car with him and he may be trying to protect whoever he was driving. Lynch is definitely facing some sort of NFL punishment, let’s hope no other bill is as well.

I honestly don’t have a clue how long Lynch’s suspension will be but my guess is anywhere from 4-8 games. However, the players association might really try to fight Goodell on any punishment too severe b/c Lynch is a first time offender and Lance Briggs recently left the scene of his car accident and faced no penalty. Granted, Briggs left the scene of the accident, not a girl lying bloody on the street so its not wholly comparable. Luckily for everyone this girl wasn’t injured too bad, so it will be interesting if her injuries play into any penalty Lynch receives.

At this point, Lynch should just take a plea deal, make sure there is a lot of community service and no jail time and wait to face his league suspension. The police have already said they are willing to make a deal, I think it going to come down to who else was in that car.

Omerta is the rule

I think if there were other players just as tanked as Lynch in the car, and possibly someone else was driving then I think the silence speaks volumes. He is protecting someone else on the team, and himself by staying quiet until the cops make their move. It’ll be interesting to see how this plays out, but honestly, Goddell will probably give him 4 games and tell him not to DUI anymore.

No more optimism

I’ve remained optimistic given the lack of information out there until today. My Star Wars heritage now has to come out: “I’ve got a baaad feeling about this.”
The Buffalo News is saying: “Witnesses have told police that Lynch was seen with two other Bills players in the Chippewa Street area late Friday night or early Saturday morning. Sources, though, said they couldn’t confirm whether those two teammates were in the vehicle.” However, they report only one witness having him driving. WGRZ has the four witness account.
Almost a week after the incident, with details coming to light, he’s gotta come clean to the cops sooner rather than later. One witness can be refuted, but four? No way. Time to man up, for all that were involved.

well looking at the schedule...

if Lynch does get suspended (and that’s an big if right now, with no official charges as of yet) here’s the games he’d miss with different lengths:

4 game suspension: Seattle, at Jacksonville, Oakland, at St. Louis

8 game suspension: the four above, plus at Arizona, Bye, SD, and at Miami (does a bye week count as a suspension week? if not, then he’d miss the Jets game as well)

the ONLY silver lining, with an eight game suspension, Lynch would come back just in time for the Jets, Patriots and MNF vs. Cleveland

Lynch

Dont rule out a year long suspension. This is a hit and run. What “if” the woman had died or been critically injured, paralyzed for ex. Goodell will not look at this softly. I would be shocked if this suspension is 4 games. I would say the odds or 75% 8 games; 10% 4 games 10% season; 5% No suspension or other.

Thurman case

“The specific reason for the banishment isn’t known.” This applies to Thurman but Lynch (and us) should be worried. Thurman pled no contest to a DUI. He was later charged with assault but the case was dropped. He will miss the 2008 season and possibly beyond.

As has been discussed previously, Goodell is putting a disciplinarian stamp on the NFL. At least as it relates to the players…

Thats the reason why he has been out so long, and what do you want to bet there is another incident that came to light right after the NFL let him back in? I would bet thats what happened and Goddell is just going to toss the book, kitchen sink, and bathtub at him.

Really?

I hadn’t read that he’d failed 3 drug tests. If memory serves, he missed one (which counts as failed) and then had a DUI. The assault charges were dropped. I can’t think of anything else illegal he’s been accused of or done. Neither can PFT. Having his coach say he doesn’t want him back certainly didn’t help his cause…

Yeah, that’s right – missed one test, had a DUI, and then the dropped assault charges. I think Goodell just really dislikes him. Or he dislikes the Bengals. If Thurman were a Patriot or Cowboy, on the other hand…

Supposedly, he’s failed one more since being cut; the 2008 reinstatement is supposedly connected to the drug policy. Which makes utterly no sense; he’s being tested at least twice a week. Who would take a banned substance when you know you’re going to be tested for drugs the very next day? My guess is he missed another test; or else got a false positive from prescription medication. (say, antidepressants? He’s a recovering alcoholic with no job, even though he is attending AA…) Especially since he didn’t fail a test while on the Bengals roster; it was only after he was cut.

And everyone constantly equates Odell with Pacman Jones, who’s been arrested, oh, six times in the last three years – most plea bargained down from felonies to misdemeanors. Plus a number of “incidents” where he came to the attention of the police. Completely different…

Let's see what happens now

OK let’s remember how the game is played. The police will posture by saying thay have witnesses or videotape they may or may not have. They will try to roll the players over on each other.

Someone will get charged now if the police are being truthful and that player will likely be suspended if convicted (or pleads guilty to a lesser charge).

Any chance the fact Goodell is from Jamestown means he will grant leniency? ;-)!
