More and More Speculation

Based on the news of what went on today (Very little), let's make some more guesses.

1. The DA does not have enough information to say who was driving. He now hopes to rat out the passengers. KEEP YOUR MOUTHS SHUT! Also, there is NO WAY ML can be charged with any form of drunk driving. Give that argument up. 

2. A plea deal is being negotiated. Obviously, this always means to a lesser charge. The lesser charges may include one of the following: 1. Adjournment in contemplation of dismissal. No plea is involved here because of lack of evidence. The ACD is the plea deal. 2. Conditonal Discharge. There is a plea to something which is sealed if you keep your nose clean. 3. Plea to attempted leaving the scene. Sounds nutty to me, but wifey says it happens. The lasik could be brought in here. Again it would be sealed for good behavior. Those are now the most likely judicial possibilities. Nothing heavy here folks, as long as no one rats. Also, at this time there is no way to know if ML's attorney is negotiationg yet. But eventually this will happen.

3. The civil case (like OJ) will be potentially more damaging. Here is where ML's attorney will make his money. This will take time to work out. I have no guess as to how much time is involved.

4. You all are right in that the penalty most impacting the team will come from Goddell. I also say 2 games max. No sub needed.

I wonder if ML's SUV has tinted front windows. Illegal in NYState but not enforced. That may be the reason the driver cannot be IDed. Hard to believe his dreads cannot be picked up. Camera angle is another reason. Caffery has a very cool head. If I get into trouble on the road, I'd hire him in a flash.

I just dont see a suspension

I know hit and run is different but Lofa Tatupu just got nailed for a DUI and will in all liklihood not get any suspension. This will all blow over and hopefully Marshawn learns his lesson and also takes care of the woman IF in fact he was driving. This whole thing is just getting ridiculous. We still dont know anything and the longer we dont I think the better its looking for Marshawn.

I disagree. Getting drunk and driving and caught is one thing.
Getting drunk and driving and running somebody down is another.
Gettting drunk, running somebody down, leaving her lying on the street, while two other NFL players (that’s Bills players) are in the car is another animal altogether. Goodell has to suspend all three if he can determine who they were.

Keuka, does wifey have an opinion on what Caffery might have offered as a precondition for talking to the D.A.? They were only in there five minutes. It sounds like he walked in, offered something like, ``Lynch will talk if he gets immunity from prosecution,’’ it was rejected out of hand, they stood up and walked out to face the media. Wonder what the offer might have been? Do you think he offered to allow Lynch to talk if they gave him an ACD?

Also, could the civil negotiation (i.e., paying the victim off) take longer than the season to resolve? If so, doesn’t that affect what Goodell does?

Gregg Rosenthal

Gregg Rosenthal over at rotoworld.com had this to say about Marshawn Lynch and I whole heartedly agree, the league rarely has punished first-time offenders for anything save dog-fighting and shotting up a strip joint, here are Rosenthal’s thoughts:

“It appears that Marshawn Lynch’s legal problems won’t be resolved this week, but they should be relatively soon. The district attorney believes Lynch was driving the vehicle involved in the alleged hit-and-run accident. My gut feeling jail time is extremely unlikely. If he agrees to a plea to a misdemeanor, it also seems unlikely that the league will punish him as a first-time defender. We’re not changing his top-ten overall ranking yet. Lynch is largely ranked so high because we expect his workload to be among the league leaders. The Bills want to throw the ball more to him, which would also help.”

What can the Grand Jury realistically do?

Keuka, here’s another legal question:
D.A. Clark is threatening to empanel a Grand Jury to ``get to the bottom of the case,’’ and he says he’s willing to wait for as long as it takes to resolve. (I think that’s posturing for his constituents, but let’s set that aside for the moment). I assume what he intends is to subpeona the two other Bills players to testify, then file charges on Lynch based on their testimony.
This is a misdemeanor charge. How realistic is it that he will form a Grand Jury for a minor charge? If the two other players would refuse to testify, what penalty would they face? (Setting aside for the moment the issue that they would be throwing the best player on the team under the bus).

Drip....drip....drip

Clark seems to be happy enough to keep this story in the news. Naturally, part of that is due to getting to see his name in the paper but it really is helping his cause. Lynch really needs for this story to go away and it won’t be going away anytime soon.

If the DA gives immunity to the other two players in the car can’t he then force them to testify?

But

thats if they know who the other players are. I don’t see there being much of a civil case, she walked to the ambulance, went home after stitches, was at work the following Monday. Can’t say she was disabled by this. As to the lasik he couldn’t see very well so he had the proceduce so he wouldn’t hit people while driving-Gee I knew I needed this op because I was driving and hitting people!!!

If Lynch had Lasik to see clearly without corrective lenses then he was legally required to wear his corrective lenses when driving prior to having Lasik.

Wouldn’t it be ironic if ML had his lasik done in Toronto, one of the leading centers in the world for that procedure. Tiger Woods had his peepers done there. They have the most up to date technology.

DA Clark

sure seems to be grandstanding. Wifey has never heard of a grand jury being impaneled for a misdemeanor. His only chance is for the other two riders to come forward. If the other passengers were Bills, what are the odds any of them will talk? Hard to say what preconditions Caffery asked for. Just trying to find out what Clark knows. If Clark gets a grand jury, the riders would beforced to testify. Odds are then that a plea would come first. Best guess is that Caffery is negotiating the civil matter now, to defuse the situation.. Interesting that in most all the NFL players cases like this, all pertinent info comes out much sooner. This will take a bit more time. Clark has basically schmotz.

I like schmotz. If Clark cannot make a charge stick, then at worst we’re looking at a plea from a first-time offender with impaired vision (yeah, nice try Marshawn). In that case, how hard can Goodell hit Lynch with a suspension?
I’m not worried about the civil case. Throw the young woman 30 grand, Marshawn. You can afford it and she’ll be happy as a clam. On second thought, better make it forty. The dollar is down against the Canadian.
Last week, Clark sounded like he had the guy nailed to the wall, not to mention two other Bills. Now it looks like quite a different kettle of fish… schmotz is a species of fish, right?

Lynch

Everyone’s main concern is how long will the Bills be without Lynch due to a possible suspension. Doesn’t anyone have any concerns that Lynch was driving or a passenger in his vehicle that struck a female, knocked her to the ground and not knowing if she was injured or dead, just continued to drive on, leaving her laying in the street.. He should join Pacman and sit out the entire year. And that should be handed out by the Bills and then whatever the NFL decides is punishment would be frosting on the cake. Lynch has absolutely no morals or character. Why should he remain on this team.

People have done much worse and been forgiven. Why should we hold Lynch to a higher standard than the rest of the NFL or society for that matter. It is part of our culture not to hold people personally responsible for their actions. We look as hard as is needed to find an excuse for them, or a reason why they have paid their debt. Can you believe we used to hang horse thieves not that long ago!!!
